An administrative fine (bestuurlijke boete) is a sum of money a Dutch regulator imposes as punishment for breaking a statutory rule, without a prosecutor or a criminal court (Article 5:40 of the General Administrative Law Act, Awb). Because it is punitive, fair-trial safeguards apply from the first question aimed at fining you, including the right to remain silent; the main exception is that you must still cooperate with inspections and hand over existing documents (Article 5:20 Awb).

Judicial review only follows if you ask for it within six weeks. Below we explain which regulators fine, the procedure and deadlines, how the amount is set and reduced, and what to do when an inspector arrives.

What is the difference between a fine and a remedial order?

Nederlânsk bestjoerlik rjocht distinguishes remedial sanctions (herstelsancties), which end or undo a breach, from punitive sanctions (bestraffende sancties), which add a penalty (Article 5:2 Awb). The administrative fine is the standard punitive sanction and counts as a criminal charge under Article 6 of the European Convention on Human Rights (ECHR).

Rjocht om stil te bliuwenYes (Article 5:10a Awb)No; duty to cooperate (Article 5:20 Awb)
Double punishmentExcluded (Article 5:43 Awb)Repeat orders possible

Regulators often combine both: a fine for what happened and an order subject to a penalty payment (last onder dwangsom) for what must change. These are separate decisions with separate deadlines.

Which regulators impose fines?

The Awb sets the general rules; each sector-specific statute says which breaches can be fined and up to what maximum (Article 5:46(1) Awb). The regulators international companies meet most are:

  • Netherlands Labour Authority (Nederlandse Arbeidsinspectie): fines under the Foreign Nationals Employment Act (Wav) for work without a required permit, the Placement of Personnel by Intermediaries Act (Waadi), the Working Conditions Act (Arbowet), the Working Hours Act and minimum wage law. Under the Wav, “employer” is broad: a client or main contractor can be fined for someone else’s worker. Amounts follow published fining policy rules, so check the version in force on the date of the breach.
  • Immigration and Naturalisation Service (IND): fines recognised sponsors (erkend referenten) for breaches of their duties to inform, keep records and exercise care, up to €3,000 for companies and €1,500 for natural persons (Article 55a of the Aliens Act 2000). Suspension or withdrawal of sponsor status is often the bigger risk.
  • Netherlands Authority for Consumers and Markets (ACM): under Article 12m of the ACM Establishment Act, up to €900,000 or, if higher, 1% of turnover; competition infringements are fined under the Competition Act with higher turnover-based maxima.
  • Dutch Authority for the Financial Markets (AFM) and De Nederlandsche Bank (DNB): fines under Article 1:80 of the Financial Supervision Act (Wft) and related statutes such as the anti-money laundering act (Wwft).
  • Dutch Data Protection Authority (Autoriteit Persoonsgegevens): fines under Article 83 GDPR of up to €10 million or 2% of worldwide turnover, or €20 million or 4%, depending on the provision breached.

Which safeguards apply because a fine is a criminal charge?

Five safeguards matter most:

  • Right to remain silent and the caution: anyone questioned with a view to a punitive sanction need not make statements about the breach and must be told so beforehand (Article 5:10a Awb). The Administrative Jurisdiction Division held that the moment the caution is due is judged objectively, by whether the questioning is aimed at punishing the person (ECLI:NL:RVS:2018:2115).
  • No fine without blame: the authority imposes no fine to the extent the breach cannot be attributed to the offender (Article 5:41 Awb).
  • Access to the file: on request you may inspect and copy the data on which the (intended) fine rests (Article 5:49 Awb).
  • Interpreter and translation: where your defence reasonably requires it, the authority arranges an interpreter and translation (Articles 5:49 and 5:50 Awb).
  • Juridyske bystân: you may be assisted or represented in all dealings with the authority (Article 2:1 Awb), including during an inspection.

How does the fining procedure work?

If the fine can exceed €340, the heavier procedure of Article 5:53 Awb applies: a report must always be drawn up and you must be given the opportunity to submit your views before the decision. Below that amount, both steps may be skipped.

StapWat bartDeadline
YnspeksjeSite visit, interviews, requests for documents and payroll dataGjin fêste perioade
Report (boeterapport)Dated report naming the offender and the rule breached (Article 5:48 Awb)Sent with the notice of intention (Article 5:50 Awb)
Notice of intention and your views (zienswijze)Your written or oral response to the intended fineSet by the authority, often about two weeks; ask for an extension if needed
Fining decisionDecision stating the offender and the amount (Article 5:52 Awb)Within thirteen weeks of the report date (Article 5:51 Awb)
BetellingBetelling fan 'e boeteSix weeks after notification, unless the decision states a later date (Article 4:87 Awb)
Beswier (beswier)To the authority that imposed the fineSix weeks (Article 6:7 Awb)

Exceeding the thirteen-week decision period does not in itself make the fine invalid. Your views on the notice of intention are the first real chance to change the outcome, so prepare them as thoroughly as an objection.

Why does what you say during the inspection matter so much?

Fines are often built on statements of managers and staff recorded in the report during the visit. Courts give a report by an authorised inspector considerable evidential weight, and contradicting it months later from memory rarely works.

You must give the cooperation an inspector can reasonably demand: access, and documents that already exist (Article 5:20 Awb). Once questioning is aimed at fining you, Article 5:10a Awb applies and you need not answer. Hand over existing records, but be careful with explanations of who decided what and who knew what: those establish culpability. Employees questioned as witnesses are not owed a caution, and their statements can be used against the company.

How is the amount set, and how can it be reduced?

The statute sets the maximum (Article 5:46(1) Awb), and most regulators publish fining policy rules within it. If the amount is not fixed by law, the authority must tailor it to the seriousness of the breach and the degree of blame (Article 5:46(2)). If the amount is fixed, it must still impose a lower fine if you show special circumstances make it too high (Article 5:46(3)), and it must deviate from its policy rules where applying them would be disproportionate (Article 4:84 Awb).

The court reviews the amount in full and can set the fine itself. Arguments that work in practice:

  • Limited culpability: the Administrative Jurisdiction Division has required Wav fines to be graduated by degree of blame (ECLI:NL:RVS:2022:1973). Ignorance of the rules is not an excuse; businesses must keep up with changes (ECLI:NL:RVS:2025:4419).
  • Limited ability to pay: supported by annual accounts and current figures, this can lower the fine or lead to a payment plan.
  • Cooperation and remedy: reporting the breach yourself, ending it quickly and introducing compliance measures all count in your favour.
  • Excessive length of proceedings: if the reasonable time under Article 6 ECHR is exceeded, the courts reduce the fine on a fixed scale; the CBb has set out the limits of that reduction (ECLI:NL:CBB:2025:372).
  • No previous breaches: a clean history helps; repetition is the most common aggravating factor.

Can you be fined and prosecuted for the same conduct?

No. A fine may not be imposed for a breach already fined (Article 5:43 Awb), or once criminal proceedings for the same conduct have reached the trial stage or a penalty order (strafbeschikking) has been issued (Article 5:44(1) Awb).

If the conduct is also a criminal offence, the authority must in principle refer it to the public prosecutor. It may then only fine if the prosecutor decides not to prosecute or has not responded within thirteen weeks (Article 5:44(3) Awb); the decision period is suspended meanwhile (Article 5:51(2) Awb). If a court of appeal later orders prosecution, the fine lapses (Article 5:47 Awb).

Can a director be fined personally?

Yes. An offender is whoever commits or co-commits the breach, and both natural persons and legal persons can be offenders (Article 5:1 Awb). Article 51 of the Criminal Code applies by analogy, so a person who ordered the breach or actually directed it can be fined alongside the company.

The financial supervisors use this power expressly. A personally named managing director or expatriate manager should defend separately, often with separate counsel, because the interests of company and individual can diverge.

How do you challenge a fine?

You object to the authority within six weeks of notification (Article 6:7 Awb) and have the right to be heard (Article 7:2 Awb). Then you can appeal to the district court and lodge a higher appeal, each within six weeks: to the Administrative Jurisdiction Division of the Council of State or, for financial and market supervision, to the Trade and Industry Appeals Tribunal (CBb).

An objection does not suspend the obligation to pay (Article 6:16 Awb), unless a sector-specific statute says otherwise. For fines under the Wft, an objection or appeal does suspend payment until the appeal has been decided (Article 1:85 Wft). Elsewhere, ask the authority for a deferral in writing or apply for interim relief (Article 8:81 Awb).

Can you stop publication of the fine?

Publication often hurts more than the money. The ACM publishes fining decisions under Article 12u of the ACM Establishment Act, and the AFM and DNB under Article 1:97 Wft, in principle once the decision is final, but for certain breaches as soon as possible. A decision to publish can be challenged; argue for redactions of confidential data or, where the fine’s lawfulness is seriously in doubt, for postponement through interim relief.

How long can a regulator wait before fining?

The power to fine lapses five years after the breach where the heavier procedure applies, and three years in other cases (Article 5:45 Awb). Once imposed, the fine can no longer be collected five years after the payment period expired (Article 4:104 Awb). With continuing breaches, the date on which the breach took place is often worth contesting.

Wat moatte jo as bedriuw kontrolearje?

  • Did the inspector give the caution before questions aimed at a fine?
  • Have you requested the file and the report under Article 5:49 Awb?
  • Is the deadline for your views on the notice of intention in your diary?
  • Is the amount in line with the statutory maximum and the policy rules in force on the date of the breach?
  • Can you show limited culpability, remedial measures or limited ability to pay?
  • Must you pay during the objection, or can you obtain a deferral?

What should you check as a director or manager?

  • Are you being questioned as a witness or as a possible offender?
  • Is a personal fine intended alongside the company’s fine?
  • Do your interests differ from the company’s, so that separate counsel is needed?
  • Will a fine or publication affect your residence permit, licence or reputation?

What can we do for you with an administrative fine?

  • We attend inspections and interviews and protect your right to remain silent.
  • We request and review the file and the inspection report.
  • We draft your views on the notice of intention within the deadline.

Gearfetting

  • An administrative fine is a punitive sanction under Article 5:40 Awb, imposed by the regulator itself.
  • Fair-trial safeguards apply, including the caution (Article 5:10a Awb), but you must cooperate with inspections.
  • Above €340 a report and an opportunity to give your views are mandatory; the decision follows within thirteen weeks.
  • Objection, appeal and higher appeal each have a six-week deadline; payment is generally not suspended.
  • The power to fine lapses after five years (three years for minor fines).

Faak Stelde Fragen

Is in bestjoerlike boete in strafrjochtlike feroardieling?

No. It is a decision of an administrative authority and does not create a criminal record. Because it is punitive, it counts as a criminal charge under Article 6 ECHR, so fair-trial safeguards apply.

Moatte wy betelje wylst wy yn berop geane?

In principle yes: payment is due within six weeks of notification (Article 4:87 Awb) and an objection does not suspend it (Article 6:16 Awb). For Wft fines, objection and appeal do suspend payment (Article 1:85 Wft). Otherwise ask for a deferral or apply for interim relief.

Moatte wy fragen fan in ynspekteur beantwurdzje?

You must cooperate, including giving access and existing documents (Article 5:20 Awb). You need not answer questions aimed at fining you, and you must be told so (Article 5:10a Awb).

Can our managing director be fined personally?

Yes. Under Article 5:1 Awb, Article 51 of the Criminal Code applies by analogy, so a person who ordered or actually directed the breach can be fined alongside the company.

Hoe lang hat de tafersjochhâlder ús noch om in boete te jaan?

Five years after the breach if the fine can exceed €340, and three years otherwise (Article 5:45 Awb). The period is suspended during objection and appeal.
